Cleaning firm faces class action for scanning employee fingerprints

A woman has filed a class action lawsuit against Scrub Inc. for allegedly violating the Illinois Biometric Information Privacy Act (BIPA).

Shavonne Norman filed a complaint on April 24 in Cook County Circuit Court, alleging the defendant disseminated her biometric data, including her fingerprint, to third parties without her consent, for use with the company's employee punch clock system. 

The plaintiff requests a trial by jury and seeks judgment against the defendant, plus injunctive and equitable relief, statutory damages of $5,000 for each willful violation of BIPA, $1,000 for each negligent violation of BIPA, monetary damages, attorneys' fees, costs, litigation expenses, interest and any other relief that the court deems just. She is represented by Evan M. Myers, William Kingston and Jad Sheikali of McGuire Law PC in Chicago.

Illinois' BIPA requires explicit consent before companies can collect biometric data like fingerprints or facial recognition profiles.
